1. Acceptance of Terms
By accessing or using Legacy Africa (the “Platform”), you agree to be bound by these Terms & Conditions, our Privacy Policy, and all applicable South African laws, including POPIA, the Electronic Communications and Transactions Act, 2002 (ECTA), and the Consumer Protection Act, 2008 (CPA) where relevant.
2. Platform Purpose and Disclaimers
The Platform is designed to connect student entrepreneurs for potential collaborations. We do not guarantee:
- Successful matches, collaborations, or business outcomes
- The accuracy, reliability, or trustworthiness of any user or their profile content
- Any specific result arising from connections made through the Platform
Legacy Africa acts solely as a facilitator. No employment, partnership, joint venture, or agency relationship is created between Legacy Africa and any user, or between users themselves, by reason of using the Platform.
3. User Responsibilities and Eligibility
To use the Platform, you must:
- Be at least 18 years of age, or have obtained the consent of a parent or legal guardian if under 18
- Provide accurate, current, and complete information
- Use the Platform in good faith and in compliance with all applicable laws
- Refrain from harassment, abuse, misrepresentation, or any illegal or prohibited conduct
4. Connections and Off-Platform Interactions
Any interactions, arrangements, or agreements arising from connections made on the Platform are solely between the users involved. You are responsible for conducting your own due diligence, for any information you share, and for any disputes or consequences arising from those interactions. Legacy Africa bears no responsibility for off-platform conduct or outcomes.
5. Prohibited Conduct
You may not:
- Harass, intimidate, impersonate, or spam other users
- Post, share, or distribute content that is unlawful, harmful, defamatory, or that infringes third-party rights
- Attempt to gain unauthorised access to the Platform, its systems, or other users' accounts
- Interfere with or disrupt the operation or integrity of the Platform
6. Intellectual Property
All Platform content, software, design elements, and underlying systems are the intellectual property of Legacy Africa and are protected by applicable law. You retain ownership of content you create and post, but by submitting content to the Platform you grant Legacy Africa a non-exclusive, royalty-free licence to display and use that content for the purposes of operating and improving the Platform.
7. Termination and Suspension
Legacy Africa reserves the right to suspend or terminate your access to the Platform at its discretion, including (but not limited to) where you breach these Terms. Termination may occur with or without prior notice, depending on the severity of the breach.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Legacy Africa shall not be liable for:
- Any disputes, losses, or harm arising from interactions between users
- Indirect, consequential, incidental, or punitive damages of any kind
- Any business, financial, or reputational outcomes resulting from use of the Platform
Nothing in these Terms limits our liability for fraud, gross negligence, or any liability that cannot be excluded under South African law, including the CPA where applicable.
9. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via the Platform or by email. Your continued use of the Platform following notification constitutes acceptance of the updated Terms.
10. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the South African courts.
11. Supplier Information (ECTA Compliance)
Where the Platform offers any paid features or services, Legacy Africa will provide the following information in compliance with ECTA Section 43:
- Full legal name and legal status of the entity
- Company registration number
- Physical address and postal address (if different)
- Email address and website URL
- Details of any applicable fees, payment methods, and cancellation or refund policies
